African Soul Voyages

By booking, participating in, or utilizing any services, tours, or experiences provided by African Soul Voyages (hereinafter referred to as "the Company"), all clients expressly agree to the following Terms and Conditions.

1. General Provisions

1.1. African Soul Voyages reserves the right to update, amend, or revise these Terms and Conditions at its sole discretion without prior notice.
1.2. The laws of the Republic of South Africa govern this agreement.
1.3. All bookings, participation, and agreements are subject to availability, confirmation, and acceptance by African Soul Voyages.

2. Responsibility and Indemnification

2.1. African Soul Voyages, its employees, affiliates, contractors, and agents shall not be held liable for any:

• Injuries, illnesses, deaths, or medical emergencies arising from participation in any tours or activities.

• Loss, theft, or damage to personal belongings or property during travel or participation.

• Delays, cancellations, inconveniences, or disruptions caused by weather, natural disasters, strikes, pandemics, government regulations, mechanical failures, or any other event beyond the Company’s reasonable control.

2.2. Clients acknowledge and accept full responsibility for ensuring they are medically, physically, and mentally fit to partake in any adventure, tour, or activity booked through the Company.
2.3. By booking or participating, clients agree to indemnify and hold harmless African Soul Voyages from any claims, liabilities, damages, costs, or expenses arising from their participation in tours or activities.
2.4. Clients are solely responsible for conducting their due diligence and understanding the risks involved before booking any services offered by the Company.

3. Bookings, Payments, and Amendments

3.1. All bookings must be confirmed with either full payment or a deposit as stipulated by the Company.
3.2. Clients are responsible for settling any outstanding balances before the deadline specified at the time of booking.
3.3. African Soul Voyages reserves the right to cancel bookings if payments are not received by the specified deadline. No refunds will be issued for such cancellations.
3.4. If there are changes to payment amounts or adjustments due to currency fluctuations, regulatory changes, or unforeseen costs, clients are responsible for covering any additional amounts required to fulfill their booking.

4. Cancellations and Refunds

4.1. All cancellations initiated by clients are subject to cancellation fees as outlined during the booking process.
4.2. African Soul Voyages reserves the right to cancel or reschedule services due to unforeseen circumstances. Refunds or alternative arrangements will be made solely at the discretion of the Company.
4.3. Refunds, if applicable, may incur administrative fees and are subject to processing times as determined by the Company.

5. Travel Documents and Insurance

5.1. Clients are responsible for ensuring they possess valid travel documents, including passports, visas, and permits, for the entirety of their journey.
5.2. Comprehensive travel insurance, including coverage for medical emergencies, cancellations, and personal liability, is mandatory. African Soul Voyages will not be held responsible for any losses due to lack of insurance.

6. Conduct and Compliance

6.1. Clients are required to comply with all local laws, regulations, and instructions provided by African Soul Voyages representatives during their participation in tours or activities.
6.2. The Company reserves the right to remove clients from any activity or tour without refund if their behavior endangers themselves, others, or the integrity of the tour.

7. Media and Promotional Material

7.1. By participating in any tour, clients grant African Soul Voyages the right to capture and use photographs, videos, or other media content for promotional purposes.
7.2. Should clients not wish to appear in promotional material, it is their responsibility to ensure they are not captured in media content. The Company cannot guarantee exclusion from all media materials.

8. Third-Party Services

8.1. African Soul Voyages may engage third-party providers for certain activities, accommodations, or services. The Company is not liable for any disruptions, delays, or issues caused by third-party providers.
8.2. Third-party services are subject to their own terms and conditions, which clients agree to by booking services through the Company.

9. Health, Safety, and Risk Assumption

9.1. Clients participate in tours and activities at their own risk and are required to disclose any medical conditions, allergies, or other health concerns before booking.
9.2. African Soul Voyages shall not be held liable for any adverse health outcomes, accidents, or emergencies.
9.3. Clients acknowledge the inherent risks associated with travel and adventure activities, including but not limited to physical injury, illness, and unpredictable environmental conditions.

10. Force Majeure

10.1. The Company is not liable for failure to perform or delays in providing services due to events beyond its reasonable control, including but not limited to natural disasters, political instability, strikes, or pandemics.

11. Entire Agreement and Amendments

11.1. These Terms and Conditions constitute the entire agreement between African Soul Voyages and the client, superseding all prior agreements or communications.
11.2. Any amendments or modifications to this agreement must be made in writing and signed by both parties.

12. Waiver and Severability

12.1. Any failure by African Soul Voyages to enforce any provision of these Terms and Conditions shall not constitute a waiver of that provision or any other provision.
12.2. If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
